    Resumen

    In the majority of legislation, due process originally was established as a guarantee of constitutional rights. The influence of international agreements and treaties came to protect the rights of the human person with a procedural guarantee that was appliedin the penal law. Currently this procedural guarantee applies to all other areas of law, including the administrative procedure. We say that the validity of the guarantee of due process dates back to the interpretive performance of the Constitutional Court; this due to the absenceof a clear rule of the validity of this guarantee in Bolivia, because the due process and as such was not substantiated in any legal rule; therefore, both the Political Constitution of the State of Bolivia and theCode of Criminal Procedure refer to an isolated form of some of the components of due process, but not specifically with a guarantee of due process.
