This article analyzes the concept of the enemy from de point of view of criminal law and criminology. It links ideas of Jacobs and Garland explained the dichotomy between person and enemy (not person) in a society that seeks to balance freedom and security. The criminal law of the enemy is a discursive practice and criminal policy mechanism that identifies the enemy as a threat to State Constitution of society, limiting warranties and replacing the State of Law by state of exception. This perspective legitimizes exclusion and neutralization of the enemy. Criminology of the other explain criminal phenomenon from the enemy, visualizing the discourse of exclusion, which has always been present in contemporary society. "Being intrinsically perverse or wicked, some delinquent are not like us. Are others dangerous that threat our security and do not deserve a pinch of our sympathy. The appropriate reactíon of society is the social defense: we must defend ourselves against these enemies instead of worrying about their welfare and rehabilitatíon possibilitíes".
